An Introduction of Puhanwal Abdul Qader Adalatkhah's Work Book at Family Law
Abstract
Associate Professor Abdul Qadir Adalakhaw has authored a work titled "Family Law." This work is a textbook prepared to address the issues faced by students in the country's law and sharia faculties, and it was first published in 1387 in the Solar Hijri calendar under the title "Family Law" by Miwand Publications.
In the following years, after studies and critiques from some researchers, Professor Adalakhaw decided to print a new edition and revised the content of the Family Law subject in accordance with the curriculum, addressing existing deficiencies. This work was published in 1395 in the Solar Hijri calendar by Spin Zar Milad Press.
Associate Professor Abdul Qadir Adalakhaw was born in 1333 in Delshad village, Hazrat Imam Sahib district, Kunduz province, as the son of Khush Mohammad. He completed his primary education at the Gharu school in that district. In 1356, he graduated with high honors from Takharistan School and began his studies at the Faculty of Sharia in Kabul after passing the entrance exam. He later earned his master's degree in the judicial and prosecutorial section of the Faculty of Law with distinction and, considering all academic criteria, became a member of the academic staff of the Private Law Department at Kabul University in 1362. Alongside his teaching duties, Adalakhaw held the position of General Manager of Kabul University professors in 1368 and served as the General Manager of Students at Kabul University in 1373. From 1371 to 1375, he managed the Private Law Department and worked as a defense attorney from 1377 to 1380.
He was a selected representative of the people of Kunduz province in emergency Loya Jirgas and in the approval of the constitution and served as the elected secretary of the first committee of the Loya Jirga for the approval of the constitution. During the transitional government from late 1380 to the end of Asad 1381, he held the position of head of law in Kunduz province and was subsequently appointed as head of law in Kabul province while retaining all rights and privileges of the academic staff. In early 1384, he was promoted to a higher position as the General Director of Law at the Ministry of Justice.
Based on decree number 1917 dated 5/4/1386 from the high office of the Islamic Republic of Afghanistan, with the preservation of academic staff rights and privileges, he was appointed as the Administrative Deputy Minister of Justice and continued in this position until 19/3/1389. He was then introduced by the esteemed President of the Islamic Republic of Afghanistan for membership in the Independent Commission for the Monitoring of the Implementation of the Constitution to the Wolesi Jirga, and after receiving confirmation votes from the members present, he became a member of the Independent Commission for the Monitoring of the Implementation of the Constitution from 19/3/1389. By decree 52 dated 4/5/1389 from the high office of the Islamic Republic of Afghanistan, he was practically appointed in a higher position while retaining his academic staff status and was elected as the Deputy of the aforementioned commission through direct and secret voting. Ultimately, he was nominated by the high office of the presidency as a member of the Supreme Court and introduced to the national parliament. After receiving confirmation votes, he was appointed as a member of the Supreme Court by the decree number 108 dated 11/1392, 10 from the esteemed President of the Islamic Republic of Afghanistan.
Professor Adalakhaw is the founder and first responsible manager of the Legal Awareness publication of the Ministry of Justice, while also serving as the responsible manager of the Constitution Magazine and a member of the editorial board of the Justice Magazine, which is a publication of the Ministry of Justice. He is fluent in Dari, Pashto, and Uzbek, has a good command of Arabic, and also possesses knowledge of Russian and English.
He has authored the Family Law textbook and has published over 45 scientific and research articles in reputable domestic journals such as the Journal of Social Sciences at Kabul University, the Kabul University Science Faculty Journal, the Justice Magazine, the Legal Awareness publication, Tebyân, Aryana, the Sharia Journal, the Law Magazine, the Judiciary Magazine, the Law and Society Journal, and the Brother Nations Journal, among others.
